1. Introduction
Welcome to “FastFound” application! These T&C govern the use of the Application and by accessing and using it, You agree to comply with and be bound by these T&C. If you do not agree with these T&C, please refrain from using the Application.
2. Definitions:
2.1 Application means an information resource that is available on the Internet and which uses a domain name fastfound.az.
2.2. Business entity means a legal entity and an individual entrepreneur carrying out commercial activities.
2.3 Fastfound means the Application.
2.4 Firm means a business entity using the Application.
2.5 Individual means a physical person having a full civil legal capacity, who does not qualify as a business entity, and who uses the application solely for personal needs and on their own behalf.
2.6 T&C means these terms and conditions.
2.7 User or You means an individual, a firm, or their representatives who access the application.
3. General Provisions:
3.1. These T&C outlines the rules and conditions for granting Users the right to use the Application.
3.1.1. The Application provides an online platform that allows Users, as part of their professional activities, to advertise, market, sell, and/or offer their services including (without limitation) ordering, purchasing, booking, transporting, and/or freight forwarding services. By using the Application, You may enter into a direct (legally binding) contractual relationship with respective service provider from whom you purchase or book a service. Fastfound acts exclusively as an intermediary between You and other Users of the Application, providing them with the opportunity to view relevant data on the conditions for the provision of services.
3.1.2. While acting as intermediary, information posted is based on data provided to us by Users of the Application. Users who post and promote their transportation and/or freight forwarding services are solely responsible for updating information on prices, rates, fees, availability of vehicles, goods, rules, conditions, and other data displayed on the Application. For the avoidance of doubts, we do not verify and cannot guarantee the accuracy or completeness of all information provided by other Users of the Application. Each User is responsible for the accuracy, completeness, and correctness of the information they provide, including rates, fees, prices, rules, conditions, and the availability of vehicles and goods. The Application is not to be considered a guarantee of the quality of services provided by Users, the level of service and other relevant matters, unless expressly stated otherwise in the Application.
3.2. These Terms and Conditions applies to both registered and unregistered Users of the Application.
3.3. Each representative of a Firm, unless there is sufficient reason to believe otherwise, is considered to be a duly authorized representative of the corresponding Firm, and it is understood that the provisions of these T&C apply to the Firm in full.
3.4. These T&C becomes available to the User upon after unloading and using the Application. Using the Application, any services, and/or registering an account signifies the User's consent to and unconditional acceptance of all the terms of these T&C.
3.5. Fastfound reserves the right to change these T&C at any time without prior and/or subsequent notification to a User. However, the registered Users will be notified of such changes through their accounts. The continued use of the Application and/or services after any changes to these T&C implies the User's unconditional acceptance of such changes.
4. Copyright and Intellectual Property:
4.1. All content on the Application, including but not limited to text, graphics, logos, images, videos, and software (other than those used and uploaded by Users, is the exclusive property of Fastfound or its licensors and is protected by applicable intellectual property laws.
4.2. You may not modify, copy, reproduce, transmit, distribute, or use any content from the Application without the express written consent of the Application, except as expressly permitted under applicable laws.
4.3. The names, logos, and trademarks used on the Application and referred to “Fastfound” are trademarks protectable under the applicable laws. Any use of these trademarks without our express written consent is prohibited.
4.4. Other product or company names mentioned on the Application may be trademarks of their respective owners.
5. Registration:
5.1. When registering on the App, the User agrees to use their own data and information, as well as data and information for which they have the right to use.
5.2. Users are required to review these T&C before using the Application. Using the Application signifies your agreement with these T&C.
5.3. We reserve the right to interact with Users through the information they provide during registration and while using the Application, in accordance with applicable laws and our privacy policy.
6. User Conduct:
6.1. You agree not to use the Application for any unlawful, defamatory, harmful, offensive, or objectionable purposes. You must not transmit, post, or distribute any material that could violate these terms.
6.2. Fastfound reserves the right to take any necessary action, including restricting or terminating your access to the Application, if it believes you have violated these T&C.
7. Disclaimers:
7.1. Your use of the Application is at your own risk. While Fastfound strives to provide accurate and up-to-date information, we make no representations or warranties regarding the accuracy, completeness, or reliability of the content on the Application.
7.2.We disclaim and do not bear all or any liability for any direct, indirect, incidental, consequential, or special damages arising from your use of the Application, including any loss of data, profits, or business opportunities.
7.3. The Application is provided "as is" and "as available," without any warranties of any kind, including but not limited to fitness for a particular purpose.
8. User-Generated Content:
8.1. Users may upload images, videos, text, and other content to the Application. By uploading content, you represent and warrant that you have the right to do so and that the content does not infringe upon the rights of any third party.
8.2. Fastfound does not endorse or control user-generated content and is not responsible for the accuracy or legality of such content.
8.3 If Fastfound discovers that any information placed in the Application by a User is prohibited from being disseminated under the applicable law, or if it receives instruction from regulatory authorities regarding such dissemination, Fastfound will promptly delete this information from the Application without providing prior notification to the User. The non-exhaustive list of what is considered to be the prohibited content can be found there[1] .
9. Additional Verifications:
We reserve the right for additional verifications of the accuracy of the data associated with your account, including the validity of your Firm registration and the correspondence of the name and registration (identification, tax) code (number) of your Firm in the available official sources. We may refuse profile verification or subsequently cancel your status in case of any discrepancies.
10. Multiple Accounts:
10.1. Users are strictly prohibited from creating more than one account. Each User is allowed to maintain only a single account.
10.2. In the event that Fastfound detects the existence of multiple accounts created by a single User, it reserves the right to impose restrictions on the User's accounts, including but not limited to temporary or permanent suspension of access to the Application.11. Language
You acknowledge and agree that You have read and fully understand the terms and conditions outlined in these T&C, which are provided in the English language.
